At the Brockport Village Board meeting on Nov. 17, Brockport resident Kim Eallonardo asked the board to reject a proposal for the construction of three berms on South Avenue, citing the proposed building sites numerous violations of both Brockport Village Code and a state ordered cease-and-desist.
Earthborn Materials, LLC, the company currently working on the property, is a local joint venture that “turns construction waste into usable products [mulch, topsoil and compost] to be resolid in both retail and wholesale markets.” Earthborn Materials began work on a site at 180 South Avenue in late 2022, and has been repurposing waste on the site since.
In July of this year, the Supreme Court of the State of New York ordered Earthborn Materials to immediately cease all processing and stockpiling of organic material. Earthborn has continued to utilize the site, despite the court order that “all stockpiled materials must be removed” by Dec. 12 of this year.
In her argument, Eallonardo presented Earthborn Materials’s open violation of Village Code, including (1) illegal excavation and soil removal, (2) stockpiles exceeding ZBAConditions, (3) unapproved exterior lighting, (4) noise, truck traffic, and hours-of-operation violations, (5) failure to respond to complaints, and (6) visual evidence of deterioration at the building site.
Eallonardo isn’t the only resident opposed, as over 85 other Brockport residents have raised nearly $14,000 dollars to a fundraiser called “Save Brockport!” in an attempt to stop Earthborn’s work in the area.
While it’s unknown whether or not Eallonardo and fellow Brockport residents’ concerns will be considered, the Brockport Village Planning Board will review and vote on the proposed site plan at the Dec. 8 meeting.
